Total Disability: Temporary

Temporary disability does not have a specific definition under Oklahoma’s statutes.  But, it basically means that you cannot perform your regular job or any alternative work the employer allows due to your injuries.  As a result, you will receive compensation for total loss of wages during your recovery and possible job training for a new position in the company.

Total Disability: Permanent

Permanent disability is usually much more severe.  It can involve paralysis,Total Disability in Workers Compensation loss of limbs, life, etc.  Any debilitating occupational disease you have from your course of employment is also covered under Title 85A §2(35).  You may receive up to 70% of your lost weekly wage for 15 years or until you are eligible for your full social security retirement amount.  If you are working regularly during this time, the Workers Compensation Commission may suspend your benefits.  Your family is also eligible for certain benefits if you die on the job.
