Oklahoma law allows for expungement of juvenile records under Title 10A § 2-6-109.  So, if you have records that are currently public or open, then you can file a petition.  If the court grants your expungement of juvenile records, your identifying information and the legal actions will remove from your record.  However, you must meet the following requirements:

  1. Be at least 21 years old;
  2. Have a clean record as an adult (i.e. no deferments or suspension of sentences);
  3. Complete full payment to the courts regarding the fines and costs of the charge; and
  4. Have no other criminal convictions.

Process of Expunging Juvenile Records

The process for an expungement is fairly streamlined.  First you will file a petition with the court.  Next, the court will set a hearing.  Once this occurs, 30 days notice will go the the DA, OSBI, Office of Juvenile Affairs, and any other arresting agencies.  The agencies will have the option to object to your petition.  If no agency objects and the court finds that the harm to you outweighs the public interest of keeping the record, then you will receive an expungement.  As a result, you no longer have to list the conviction on any paperwork.  Further, the record will seal and be up for obliteration after 10 years.  This is subject to the record not being unsealed for any reason though within those 10 years.
