Oklahoma Holographic wills are enforceable but must done done correctly. While some people go through the wise process of hiring a Wills and Trust attorney and setting up a will prior to their passing, this does not always happen.  Sometimes, a will is a handwritten document.  More recently, wills have become popular as internet print-offs that are filled-in by hand.  The state of Oklahoma recognizes certain print-off versions and handwritten versions of wills.  Legally, these are known as a holographic will, and may stand up in court.

Whats an Oklahoma Holographic Will?

While Oklahoma views a holographic will as legally valid, it must have certain elements.  The following is a list of what must be present for a holographic will to stand up in court.

  1. Whomever the will belongs to must entirely hand-write the will.
  2. The will must be dated by the person making the will.
  3. The will must be signed by the person making the will.

Oklahoma follows these guidelines loosely.  The will doesn’t even have to be written on paper to be valid.  As long as the will is signed, dated, and handwritten it generally works.  Not all states though recognize holographic wills.

Due to the lack of formality in a holographic will, these are often contested in court.  For instance, a this type of will does not require witnesses or notarization.  This sometimes leaves room for people to allege forgery, especially if the deceased is wealthy or has left someone out of the inheritance.  This can lead to extensive court battles.
