Second Degree Burglary crimes in Rogers County are aggressively prosecuted by the District attorneys office in Claremore. An Oklahoma City woman recently turned herself into authorities after being featured on Oklahoma’s Most Wanted for two days.  Kiaira Johnson was with a man outside an apartment.  Once the resident of the apartment left, the two broke in.  They fled from a back window.  Later forensics matched her fingerprints with one on a computer monitor of the break-in scene.  As a result, the woman is facing charges on second degree burglary.

Second Degree Burglary in Rogers County

Second Degree Burglary is under Title 21 § 1435 in the Oklahoma Statutes Ann.  The statute reads:

[Anyone] who breaks and enters any building…., room,….,automobile, truck, trailer, vessel or other structure or erection, in which any property isBreaking and Entering kept, or breaks into or forcibly opens, any coin-operated or vending machine or device with intent to steal any property therein or to commit any felony, is guilty of burglary in the second degree.

As you can see, second degree burglary essentially means breaking into any place that you are not welcome in with intentions to steal.  However, the commission of any felony or intention to commit any felony will also result in second degree burglary charges.

Second Degree Burglary and Legal Consequences

Title 21 § 1436 of Oklahoma law lists the punishments for second degree burglary convictions.  This is a felony offense and is subject to a 2 to 7 year term in the State Penitentiary.  You may also have to pay restitution to the burglary victim for property damages, etc.
