Possession of drug paraphernaliaOn February 3rd, Tulsa Police arrested a woman for possession of drug paraphernalia and aggravated drug trafficking.  The woman had several bags of methamphetamines hidden in places around her home.  Further, this included a 2 lb. bag of meth behind the washing machine.  Police also discovered scales and a glass pipe which is commonly a tool for meth use.  Oklahoma Statute Title 63 §2-405(B) addresses possession of drug paraphernalia.  It says:

 “No person shall use drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a controlled dangerous substance… .”

As you can see this statute covers a wide range of drug manufacturing, selling, and use.  The standards for “drug paraphernalia” are in the Uniform Controlled Dangerous Substance Act.  These include the presence of residue, location of the item and if actual drugs are nearby, and any statements about the items from the suspect.

Penalties of Possession of Drug Paraphernalia:

A first offense is usually a misdemeanor with fines up to $1,000 and a maximum of one year imprisonment.  However, punishments do increase if the offense is repeated.  So a second conviction would have the same prison sentence and fines up to $5,000.  But, if you receive a third offense or more the fines increase substantially and may reach $10,000.  These penalties and fines are only regarding the possession of paraphernalia.  If you face drug paraphernalia charges in conjunction with other charges, such as trafficking or intent to distribute, you will have other penalties too.
